Hi,
I am currently on my 6th year in H1b. My current H1b visa is expiring on Nov 7th 2016. My Perm was filed on Dec 21st 2015 (That is basically NOT before 365 days of my current expiry date).
If I go to India for 2 months (for example), will the re-capture happen right away and my new expiry date will be Jan 7th 2016? & Does it also mean my Perm filing was done 365 days before the H1b expiry?
Any inputs on this is greatly appreciated.
