My H1B visa has been extended till Oct 2017 (6 yrs completed) and don't have I-140 approval yet.
I'm working for a client through consulting company A. Company A decided NOT to file my PERM, even though my contract still valid an another year (May 2017).
Company B (vendor of my client) will to transfer my H1 and start PERM process. But they are willing extended only till May 2017 based on client letter and promising that we will find a new client after May.
PERM (Labor) may take 6-9 months, if query condition 9-12 moths and then I-140 may take 2 weeks to 3 months.
Questions:
1. If I go with company B, is there any issue in Labor processing or I-140. since they are not extending maximum of my visa period, only up-to client letter date.
2. Is there any restriction for PERM/I-140 that minimum days in my visa, before file PERM or I-140?
3. Can I ask other company (friend's company) to transfer my H1 and do PERM process while working with company A/B?
Please clarify and advise.
