    Hi guys and girls,

    I have a situation here and need some help... Started my PERM process 4 months back.. So the prevailing wage which came back yesterday has a salary which is at least $30k more than what I am getting paid here!!!. But that doesn't mean i'm paid bad here its a decent salary and that what all my colleagues are also paid with equivalent experience.

    The visa department at my company thought since I am an Indian.. this dude on EB2 will get only after 8 years and hence they didn't bother. But they didn't check that I was born outside of India and hence I will get it within the year. Now they realized the mistake and thinking what to do, because they won't increase my salary by this much within a year. Maybe within 2-3 years its definite possibility.

    My manager is suggesting to file the Labour with a salary which is 20k less than the PWD - with a reason stating why the salary is less, but I am confused if this is the best way?..or is there any other options. We have to tell the lawyer on what we decide.

    Some one who exp. same please let me know.. or some bright ideas please..HELP!!

    Sounds like your employer is exploiting you based on an assumption of national origin.

      Nope. 100k my current salary, is a good enough for Texas!! No exploitation . The pwd came back with 130K.. Seems like its a problem with the application..

        If I read your words above correctly, in my book, are akin to taking advantage of your situation.
