  • Can GC process be proceeded while being working in Canada?

    Hi all

I just got my LC approved recently and expect to file 140 pretty soon. Unfortunately my case falls in EB3 category and a wellknown fact is the long wait before the visa number becomes available. I have Canadian PR and there is good chance I could be transfered to work in the Canadian branch of my company. My main question is if it is possible the GC application can continue while I am PHYSICALLY away from US like working in Canada. So I need your inputs here. Any experience, hearsays, storys good or bad, advice from you are greatly appreciated.

Yes your green card process will be just fine. Apply for your I-140 and leave the country. When your priority date gets current file for consular processing from where you live (outside US) and you will get your interview/approval in the US consulate there. They'll give you a paper that you can use to enter the US as a permanent resident and apply for work permit. Good luck!
