My husband is on H1B and his H1B is expiring on Sept 17, 2006. His LC was filed on Jan 25, 2006(less than 365 days). He had another LC filed in 2000 which got approved in 2001 (in 3 months) however, my husband quit that company and hence didn't file I-140.
For 7th yr extension, my husband sent the earlier LC saying this was filed more than 365 days (According to Yates memo). But INS denied this case saying no corresponding I-140 was filed.
My question is : For 7th yr extension is it necessary that if the LC is approved then you should apply for I-140?
