Hi its regarding pre-approved labor

My husband had applied for labor EB2 on perm basis on september 2005, nearly its 1 year but yet there is no information and now company is offering him EB3 2004 april pre approved labor.

1. if we accept this how many years its going to take to apply for I-485.
2. is there any advantage if we accept this pre-approved labor.

currently the priority dates for EB3 is Apr 2001 and EB2 its 2002. So it would take about 3 years before you file for 485 either ways. Since a lot of people have applied under Perm EB2 (since EB3 retrogressed), I have a feeling it will retrogress further than the EB3 category. So you may be better off with the EB3 pre approved labor. Again with all the commotion with immigration, you never know.
