Can Labour Certification be transferred to another company?

Hi!

I work for a company who is sponsoring my green card and the labour certification was approved about a month ago. This company is now forcing me to resign as they want to hire somebody for less money. So, I was wondering that if I end up working for another agency, can I transfer the labour certification to that agency? Or would I have to start from scratch again?

Please do advise.

No, you cannot transfer labor to another company. The labor is applied for by the company not you. So technically the labor certification belongs to the company and it can use your approved labor for somebody else.

Yes you can take an approved labor cert. with you but only under certain conditions.
