My labour is pending @Dallas BEC with a PD of 08/2001. 45 day letter recd and responded June'06.
The job description in this labour is
"MS in CE/CS/MIS + 3 years of progressive experience OR BS in CE/CS/MIS + 5 years of progressive experience".
My qualifications are BSc., Zoology + PGDCS(2 years) + DRDBMS(3 months). My educational qualification is evaluated to be equivalent to BS in MIS. I am sure that it will not fly well during 140 stage and my 140 will be rejected.
My company also filed a PERM labour and then EB2 140 now has a RFE on this. Lawyers dont know how to respond to this.
I just do not want to loose my PD and my old labour and wanted to make sure that i would be able to clear my 140 and 485 once the old labour is approved.
I have been reading through a lot of forums that if i have " H.14 – Specific Skills or other requirements :
Will accept any combination of education"
in my labour then there is a good chance that i might get approved in EB3.
I would like to make changes in my pending labour and add this text.
Is this possible? Has anyone successfully made changes to their pending labour application. How long does it take? Any chance that i will loose my PD if i do that?
My lawyers are dumb and they are not aware of this.
