My situation is as below:
I had filed for GC under EB3 with my old employer which has a PD in early 2003 and then quit them last year and joined some other company. With the new employer my LC & 140 are thru under EB2. Now my old employer recd instructions to conduct the recruitment exercise & submit the data & they are asking me if I want to continue the process.
My questions are:
1) Since the old case was under EB3 & if it continues that way then there is no point in continuing that, so is there a way I can upgrade this to EB2 now as I have added more years of experience?
2) From this stage onwards how long will it take to complete the old labor approval?
3) So, basically I want to make sure there is advantage in keeping the old case alive, any ideas?
