Hi,
I am currently working as Database developer on H1-B. My company had filed I-140 under the same title and is under processing currently. I am being offered a promotion to Database Architect position which will give me about 15% rise in salary. Some of the job responsibilties vary from my current position mainly being of higher level. My employer is currently checking with their immi attorney to see how it could impact my GC process. In the mean time, I thought of asking coule of questions here.
1. Does my situation warrant a new labor certification? Isn't it a routine situation esp since the whole GC takes years now, I can't imaging people working on same title for 5-6 years without any promotion.
2. Since I have gained lot of experience (more than 5 years in IT and 3 years in production) can I now go for EB2 (that is if I have start the GC all over again)
3. Does my situation change if I delay this promotion untill after 140 is approved?
