The second term on my H1B expires April 15, 2009. I was out side US for 30 days in past 5 years - thus the stay can be extended till May 15, 2009
I want to take up another job and the prospective employer is ready to file GC, however, their immigration attorney says the chances to file the LCA prior to 365 days before the expiration of H1 B are very slim and not worth taking the chance

1. how long does it take to prepare and file the LCA. what is the minimum duration of job posting prior to filing LCA? can the H1B be extended if LCA was filed 365 days prior to visa expiration?
2. any suggestions on, what can be done to get additional time or any alternatives?
