  • Audit Letter. Need to confirm the signature

    My lawyer received an audit letter from DOL regarding my PERM application. He sent me a PDF file about that audit letter. There is no signature on that. I feel suspicious about that letter. Does anyone else receive the audit letter without the officer’s signature? The audit letter is from Chicago Processing Center. Thanks for your inputs!

    You do realize that ...

    ... if your attorney sends you something concocted, then he/she is committing a fraud and will not only face prosecution but also lose his/her license.

    Do you think he/she will risk that?

      The thing that makes me suspicious is that he told me in advance that there will be an audit, even before he received the letter, because he said, the answer to the section H12 is "Not Normal", i.e., the job requirement for this position is "Not Normal". I didn't ask him why he should check that box to answer "Not Normal" when he was about to submit the form because I trusted him at that time. After I received the PDF file in his email and I asked to see the original letter with the signature of the certifying officer from DOL, he said all the audit letters have no signatures. Because of the audit, he is asking for extra money in order to respond to the DOL audit request. Is there really an audit or is he making this up in order to extract extra amount of money from the company? Do other people's audit letter have no signatures too? I would appreciate it very much if someone can share his/her experience. This lawyer has asked for extra fee which was not specified in the contract before. I begin to wonder whether he cares about my case or all he cares is how to blow this case up to increase the amount of his work to ask for more money. He is saying that the fee we already paid did not include the work to deal with the audit we have to send him a new check before he responds to the audit request. Thanks in advance for your reply.

        Signature on audit letter

        I have an audit letter dated June 2, 2008. The officer's name is on it but no signature.

        The real mistake your lawyer made is that he should NOT have submitted the 9089 form without correcting it if he already knew the job requirments were not normal.

          I doubt if an attorney would make it up putting his/her career at risk for a few hundred dollars.
