I first started working for this employer with OPT. After I got my H1 visa is when the problem started.
Incident #1: I went home for 3 months after my OPT expired, and before I got my H1. He verbally told me to work in Malaysia and said he will pay me after I get back. But when I get back to the states with H1, he refused to pay me. So for 3 months I was working for free. There's no written agreement whatsoever. It was my own fault that I agreed to help him and get myself in difficult situation.
Incident #2: This company does not have any system when I first joined. No fixed work hours, no tracking of vacation or hours etc. After I got my H1 visa, he forfeited my first year's vacation. (10 days). Which contradicts with the employee handbook made a year later, that unused vacations can be extended for up to 2 years.
Incident #3: My employer gave an unreachable deadline for a project, and I told him that it is impossible to reach. He never reply to my request for extension. Then, at the end of the month, he decided to not pay me for whatever hours I worked after the deadline he had set.
There are alot more petty incidents that happened to me as well as other foreign workers. Now, my question is: Is there anyway to file a complaint to the immigration? I do not want to waste the time and money to pursue a lawsuit. My goal is to raise caution to the immigration so that they will do the best to request for documentation in order to protect other foreign workers that will work for this company. We, as foreigners, came to the states to work for a reason. We do not just leave home, in my case, all alone here, to get bullied by employers. Employers know well that we probably need the job or the money badly, and bully us with their power and probably can get away with it.
