    My case....

    Bachelors - May 2003
    Company1 (India) - 1.8 years
    Company2 (India) - 1.1 years
    Company3 (USA) - 1.3 years

    Filing my PERM with Company3 and they say only 1.8**.1 = 2.9 can be counted towards my experience, hence I am eligible for EB3 category only.

    Can I somehow squeeze myself into EB2??? Any tips/tricks?

    Not possible just yet. In most cases, experience gained in the same company cannot be counted unless the new job within the same company that they need you for is more than 50% different than your old position.

      The Rule Sucks!

      So if a person joins a compay right after college and works there for 5 straight years, comes to US on a H1-B and decides to apply for his GC after 1 year, so now as per the rule he has to be EB3 as 0% (of this 6 yrs) of his experience will be counted towards the labor he is filing, since he was always with his CURRENT employeer all the time.

      Is that what you get for being loyal to your company???

      This rule sucks big time, if it all any such rule exists for real.
