    Hello,

    I have a question about Priority date. I understand that it is the date the Department of Labor receives the PERM application. My PERM LC is going to be filed shortly in May 2008. I was told by a person working in the law firm my employer is using for my case that the priority date is assigned in two halves of a month. Which means that if someone files the PERM LC between 1-15 of the month, his/her priority date is 15th of that month and if the filing happens between 16-31 of the month, the priority date is the 1st of the following month.

    Is this true? Any response from someone who has actually received a priority date would be very helpful.

    I am concerned as if this is true and my filing happens between 16-31 of May 2008, I will be assigned a Priority date of June 1. My H1B expires 25 May 2009 and that way i won't be able to file a 1-year extension. I was hoping that I will be ok if the filing happens prior to 25 May 2008, but if what i heard was true, then everything becomes a problem.

    Kindly let me know the true picture.

    NO. PD is the date your PERM is received by the DOL.

    You should make sure that your PERM reaches there before May 25 to get extension without any problem. I mean avoid border-line dates and send it ASAP.
