  • Labor Apd. I-140 filed and

    Hi,
Im working for employer A, labor approved and I-140 just filed now the client B wants to have transfere my H1-b, even employer is agreeing because we have contract to hire.
Now can my Labor and I-140 gets also transfers or do I have to restart again?

I-140 is employer specific at the stage you are at. If employer A wants to continue the GC process with you working for company B, you should be okay. GC is for a future job.

If you do not intend to join the employer once you get the GC or it's other way around, you will need to re-start from scratch (PERM, I-140) by employer B. You may still request to retain the PD from your earlier labor/I-140 if the I-140 with employer A is approved.
