    Experts please suggest.

    1. Can one apply for 7th yr h1 extension through company b, if an employee is working for company A and lab applied by company A?

  • #2
Can be done provided the labor has not expired or if a timely I140 was filed by the firm before the labor expires and if the labor was applied 365 days before the 6th year.

Thanks for the suggestion txh1. I still have couple of questions.

      1. How can I tell company B that I have labor applied from company A?
      2. Do I get any confirmation after labor is applied?
      3. Is that confirmation only proof to tell INS that we have labor applied?
      4. What other documents are required to show INS that I am eligible for 7th yr extension from company B?

        1. Are you telling me Company B does not know? If so, you have to tell them if you need a 7th year extension. Otherwise, they know you cannot stay in the US and are expecting you to go back to your country.
        2. The employer gets it. You don't.
        3. Yes. It is ETA 9089 I guess. You can also prove if you have an I140 approved as that has a PD listed.
        4. The same usual stuff.
