  • please need urgent help

    my labor is filed by my company and it was recieved by labor department on may 13th 2008.i need to know how long it normally takes for approval by ETA. also my case number starts with A. my question is are there any way i can track my case. my H1b visa is expiring on april 2009 and i will have to file for H1 extension also as well as I 140. please help me in this i am completely in dark about these procedures.

    No one can tell about the processing times for perm. Some cases get approved in a week and some could take 1 year. Also, some lawfirms have been recently under DOL audit and they are making them go through the detailed recruitment process. It depends on your lawfirm and case.

      thanx for your quick reply but i also need to know that as my H1B is expiring on aril 2009 what should i do abt that.i was on L1 visa for 5 years and then i got H1B only for 1 year. my labor was filed on may 13th 2008 and suppose if i get my labor approved by october 2008 what r my chances for 7th year H1B extension. i need to file my i 140 and i will do it as soon as i get my labor cleared.what r the procedures for that. please let me know about my chances.

        You would need an approved I140 for H1b extension if the labor was not applied 365 dyas prior to 6th year completion.

        USCIS has recently started PP for selective cases and see if yours qualifies after the labor gets approved.


        Also note any periods spent outside the US on vacations etc can be recaptured into the 6 years to buy time and ensure the 365 days compliance for labor filing.

          thnx for the info again. when i was in L1 i was in india for about 2 months on vacation in total.so if my H1B is expiring in april 25th 2009 then i think i will b ok as per as 365 days r concerned. as my labor was filed on may 13th 2008 and with the 2months vacation in total in the last 5 years i think i will b ok . as i am having 18days less for the reqired 365 days. am i right?please let me know. also many manyn than to let me know about the PP for i 140. i am also planning for that. i heard that if i get approved for it then it will b approved in 15 days.is that right?please let me know. again many many thanx for ur quick responses.
