  • Priority Date...Please Help!!!

    My Labor & I-140 has been approved & I'm planning to change my employer. So my question is do I have to start the GC process right from scratch with new employer and how do I retain my priority date & what all info/docs will be required to retain my priority date for filing I-485.

    Yes, restart from scratch and have I140 approval copy where PD is listed or copy of labor approval.

      I tried getting a copy of Labor & I-140 from my employer, but he denied giving me the copy of the I140 approval and labor approval (I do have the tracking/receipt number for both I140 & Labor) . So how do I get these docs & what are my chances of retaining the priority date if I don't have these docs. Can I still retain my PD without these docs when I start GC process with my new employer?

        The I140 tracking number should be good for the PD. You could also research into obtaining the labor certificate using the FOIA.

        Did you not make a copy of the labor approval that you had to sign before filing the I140?

          I did not got a chance to copy the labor approval. And what are my chances with out having copies of any of the docs?

                  You have been told the tracking number for I140 could possibly used to reference your case and capture the PD. Other than that, try looking into FOIA request procedure and you may not get anything out of it though. These are the options.
