  • How long must I work for a company so that it can file my labor under PERM

    Hi,
I have been employed by a company for last 1 month. It is a permanent job. I know that labor must be filed at least a year before the expiration of H1B ( full 6 years term). My H1B is going to expire after 14 months from now. Can my company apply for labor certification now or is there a requirement for minimum number of days with the company?

Any help will be highly appreciated, I'm currently in a soup !!

    -Regards
    Venkat

No such requirements for the govt but employer could choose to have such minimumns. Labor can be applied even if one is not a current employee.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
