    hi,

    I am planning to buy a house. I am on H1B Visa status. My Green Card is under process.
    My GC labour process started April 2003. I need to know what happens for some reason
    if I dont get my Green Card, do I get some additional time to sell my house. My decision
    of buying a house is very much based on this. I know you get 1 year extension when you case
    is pending with INS but what happens when for some reason your GC is not approved.

    Your help would be highly appreciated.

    As far as I know, buying or selling a home is purely your personal problem. It is no way relating to BCIS/INS. As you mentioned, once your labour application is filed 1 year before expiration of 6 years term of H-1, you are eligible to file your H-1 extension for 7 th year and continue the same until your labour application decession is made or your green card decession is made.

      In that case can I transfer to dependent Visa after 6 years. My wife is carrying H1 too.

          If your greencard gets denied, it will most likely for reasons because of which you can not stay in US at all.

          In that case, it would be very difficult to transfer to H4 also based on your wife's H1.

          If your greencard gets denied, you will be out of status immediately and will have no time to sell house etc. I know it is very tough but it is true. I personally know a friend and it happened to him.

            Nothing related to the house you will own

            There're a lot of foreigner-owned property in the states. Even when you're not in "immigration visa" there's an option called "non-immigration visa". Don't worry too much at least your agent will take care your property nicely if get paid.
