RIR denied - next steps ?

EB2 RIR applied in Oct 2001

SESA approved
DOL priority date Sept 2001
Denied RIR in NOV 2002

Seems like all s/w engineers in RIR are being denied (even if company has not had layoffs)

Dont know reasons for being denied.

- Will the application go to non-RIR processing
- Do I have to do any paper work to move it to non-rir
- What are the chances of being denied in non-RIR
- what should I do now.

Sorry to hear that, but i would suggest to follow up
with your lawyer and ask him why it got denied and
what can be done also what are your other options.

I'm in the same boat of RIR but DOL is not moving at all
for Software engineers in CA. If i get denied i will need
to contact you to see what are my options.

For now i'm thinking of applying for Canada Immigration.
One doesn't need an attorney for this a friend of mine
has done it and expecting GC within a year.

Which state your RIR was denied in? Was it California?

I think you can keep the same priority dates by converting you application to non-rir. Lawyer should be able to help you?

your dates match mine. But I haven't heard back from the labor dept. Its taking too long in CA

Have you seen the original denial letter from the labor department? you need a copy of the letter(probably original) to start over.:rollin :rollin
