    Hi, Kindly look into my query and explain to my questions.

    I am in company B now and my GC is being processed. LC has still not been approved. Meanwhile company A with whom i worked last, is offering me a job which is very reasonable in all aspects. Actually they started GC processing when i was with them , but DID NOT CANCEL. Again my H1 with company A which is valid till 2003 april is not cancelled.

    Now my doubt is 1. if i say ok to job offer by A, will my h1 be considered as a transfer like a regular h1 transfer or i can without any doubt in mind start working immdly as i have a valid h1. What should the attorney do, to make the previous h1 the current one. 2. I know my LC is approved back in Company A an year back. only thing they HAVE NOT cancelled any of the legal things associated. Will i be eligible for i-140/485 submission as soon as i join the work there. Please help and guide in this, as consulting so many, i am very much confused. Thanks!Can you please treat this as urgent

    H1 and GC are two different things. GC is for future job and approved LC is valid forever once it is approved. Your employer can use your LC for other employer, if the job description is same. So if you join and start working for Company A, they can use your approved LC.

    I believe even you do H1 transfer or join directly, I140/I485 can be filed, but talk to your company attorney for legal procedures. Hope this helps and best of luck.
