  • LC vs NIW for a foreign doctor on H1, previously on J-1

    Hi
    I am a foreign medical doctor and recently obtained my H1B visa.(I was on J-1)
    I have to do my J-1 waiver job in a medically underserved area.
    The job is lined up and ready, everything is fine.
    Now, I have to decide which way to go for the green card, either NIW or LC.
    I have read about both but still do not know which one would be most beneficial at this time.
    Can anyone help me ?
    I would be very grateful

    It is more than that. You have to look at both and match with your background. If you qualify for NIW, that is lot more quicker in getting your Green Card.

      I visited the website and it was very good.

      I do qualify for NIW, I have been told by my lawyer that I can choose any one, but since I am doing my waiver job, I can not apply for NIW until I finish 5 years of work.
      Labor cert he says- takes shorter, you can apply by the end of 3 years, but in the end it will be ready by 4 1/2 years, so it is only about 6 months earlier than NIW, and it is more of a hassle.
      Also after the NIW 5 years, nobody knows how long it takes to get the green card once it is approved...

      But I have not been able to find this in writing anywhere.
      Also, with the uncertainties now after 9/11 I do not know which pathw would be safer...
      Can you help...??
