  • Newbie - Need Help

    Recently my company X agreed to start my green card processing. I joined the company X on April, 2001 through their Columbus, OH branch, but through their Kansas Branch, I started working for a client in Kansas City, KS. I get pay-checks from their Corportate Office in Jacksnoville, Florida. I'm having Master's Degree in Engg and more than 5 years of experience.

    Company X has multiple branches (almost 50 branches) in US. So if they start my green card, in which state they can file my LC? Will it be, where I work (Kansas), or Branch Office which started my H1 (Columbus), or Corporate Location (Florida)? or will it be where I file my State Taxes (Kansas)? Can I request them to start at any fast processing state? What will be the safest way for not being rejected in LC stage?

    What other questions, I need to ask the Company X for filing green card (like RIR etc)? Any information would be of great help to me, as I'm very new to this green card process.

    Not Legal Advice:

    If your job is permanently located in Kansas then you will need to file everyting (LC, I140) there.

    If the company intends to move you around in your GC Job then they should do it in Florida where their headquaters are located. Probably Florida is where they will do it.

    Labor Cert:

    RIR is definitely the way to go. It is much faster though somewhat riskier. However if you have a competent attorney the risk is minimal and the time savings vastly outweigh it.

    You will also want to file in the EB3 category (regardless of your actual qualifications) as EB3 cases tend to generate less Requests For Evidence (RFEs) than EB2 or EB1 - therefore less delays in the I140 process. However they require more attention in the LC Part.

    When you do the Labor Cert and I-140 there are questions on both sets of forms about whether you will Consular Process or Adjust Status. You should always select Consular Processing - no matter what.

    The whole system was originally establised with this in mind so apparently (at least according to my lawyer) it makes things go smoother with this option selected.

    Changing From CP to AOS is easy and Quick. Changing from AOS to CP can cause major delays.
