  • GC process when out of the country

    hi!
Can one continue with the GC process when one is out of the country and employed by a branch of a US company. Does the US company still have to keep the employee on its payroll even if the employee receives a salary abroad from one of its branch offices.

If anyone has an idea on such situations, pls reply back.

    Thx

For the first two stages of the GC (Labor Cert and I-140) you may be out of the country. There is no need for you to be on the U.S. company payroll.

At the last part, you'll need to decide if you want to do Consulate Processing or come back to the U.S. on an H-1 to file your I-485 here.
