Hi,

When was your Labor filed ? Did your company send the DOL a list of all the people who responded to the ad and why they were rejected ?

Your lawyer should be careful with this one!

Lately, the Employment Development Department in California has been changing the rules about what they want from an RIR application. Really, what they want is a list of the RIR materials, signed by a company official. They argue that anybody can copy newspaper ads from the paper, and print websites from the company's webpage, and send in an RIR application without the company really knowing. So they want to see a list of what's been sent, in writing and signed.

The EDD has been sending out assessment notices that make it look like not enough RIR has been sent, when what they really want is this new format.

Your lawyer may call the EDD and ask to be told what, specifically, the EDD wants to make the application "okay." But he shouldn't take it at face value that not enough RIR was sent.
