    Hi,

    I wanted to start my Labor process. My employer (Company A-my Petitioner) is going to merge with the company B and thus he proposed me to file your my Labor with company B. I am wondering how one can apply a labor with other company B while his petitioner is company A? I am getting my pay check from the Company A.

    Currently, both the companies (A & B) are running on their different own HR and in next six month they are going to club together in one single Company.

    Please suggest if I choose to apply through Company B then do I need New I-797 with new Petitioner (Company B)?

    You can ...

    ... have a company file for your employment based GC even if you're not working for that company.

    The GC application is for a permanent position in that company, it has nothing to do with any current temporary position you may have with another company on a H1B visa.
