Labour Certification Status on job change

If I change my job but the new place is within the
city where I work , would I have to do my LC again
or can I start directly with I140 at the new
place. Also right now I am in EB3 category.
Can I reapply I140 with EB2 category.

I have B.Sc(3 years 1992) and Post graduate Diploma in Computer application(1 year) which was evaluated as Bachelor degree when I got my H1.I have completed 4 and 1/2 years in US and having some years of experience in India.My attorney says my case will be EB2.
Will I be qualify?
Do i need experience letter from previous employers? what if they denied?
