EB2 or EB3????

Hi,

I have BE computers(India) & MS computer(US)plus 1 yr of work experience before coming for my MS to US.
I have started my GC process through a consultant.
My salary right now is $50,000 per year. My lawyer said my Privilege wage is 102,000 per year. I want to apply in EB2 category.
Will there be any problem if I apply in EB2 category with 50K salary???? Please advise. My consultant is advising me to go via EB3 process & I don't want to.

Who are you trying to mess with? The job should require an EB2 qualification and not the candidate in the first place.

If the wage determination for EB2 comes out to be 102k, with 50k, you are just wasting money as there is no way the I140 will get approved. Does the consultant even have profits to pay you 102k? that also comes into picture during I140.

Hello txth1b,

I have a question after reading the above post. My employer is about to start the PERM for my GC under EB2 category. I'm not with any consultancy (Non IT, direct hire). How do I know with the salary i'm making I will be eligible for GC under EB2 category. I have discussed the job requirements and my qualifications with my attorney, and he didn't even come up with any questions regarding the pay!

Plz give me any inputs on this or any link that I can read and get some info on this.
