  • EB2 Eligibility...Masters from India???

    My company is going to file LC... Requirements are Masters Degree with 2 years of experience in the related field (to satisfy EB2 eligibility).
    My company's attorney is mentioning only 4 areas under technical skills where as my job involves more than 4 technical areas and I possessed experience in all these areas in my previous employment.
    1. I am not sure whether it is advantage or disadvantage if I ask them to add more technical areas?
    2. I am not sure if my education is okay for EB2? If not I can now ask my employer to change the requirements to make it to suit for EB3.
    Experts please reply...it is urgent because my employer will not change the requirements in the later stages once the LC is filed.

    It is illegal to change job requirements to meet the eligibility needs.

      my company initially wanted to file it under EB3 only but decided to go for EB2 later.

      Can you please let me know your thoghts on the 1st question?
      (I am not sure whether it is advantage or disadvantage if I ask them to add more technical areas?

        It depends. The advantage would be to screen candidates and eliminate the ones that do not qualify. The disadvantage would be if you want to use AC21 later during your GC, you would have to find a same/similar job which would require all the skills listed on your labor to make it qualify for a job change.
