    Hi

    My Company applied for my PERM last year and it went into audit. Its been more than one year and still not heard from the DOI. My company says tthat they are processing audits for July 2007 and my audit came in Sept
    My Question is what are my options now?
    My h1 expires in May 2010..

    1) What is the current process level.Meaning how long is it taking and is my case an exception or is it happenning with everyone
    2) Can I apply for another PERM along with the current one? If my employer agrees? What is the implication
    3) Will I be allowed to extend my H1 after may 2010 if (hoping it does not takes longer than that) Audit does not complete
    4) Is there any impact on I-140 or 485 due to this audit?


    One more question..If in H1 can u change the industry from IT to something else..meaning can the new employer ask for transfer of H1 from IT to another industry? Or will I be required to apply for fresh H1?

    H1 expiring in a year and Labor not approved yet

    Hi,
    My case is similar to yours. I applied for labor in Dec 2007 and got audit in Jan 08 which was replied in Feb 1st week. In Nov 08 there was a circular from DOL that they are responding to audit cases with July 07 priority date and just last week there was one more circular from DOL that they are responding to audit cases with Aug 07 priority date. So in 3 months they progressed 1 month. At this rate to reach Sep date it might take another 3 months (in my case it might take a year to reach December).

    So I am contemplating to apply for a parallel GC processing with another consultant. I am researching whether this is a good idea. Any thoughts from you or anyone is greatly appreciated.
