  • PERM processing time

My PERM was filled on Sep, 2008 and when I spoke with lawyer, they are telling that nowdays PERM processing will take nearly 7 months to approve labor and I applied on EB2.

Is it actually taking 7 months to approve labor ?

    PERM processing time

My labor was filed on July-2008, My employer says still it is not processed.
    Only God knows the truth.

It is almost 6 months.. If 7 months is true , then I should get it next month.

Any one reading to this, update with your status of PERM, so that we get some idea about PERM processing time.

        Labor filing status

Applied in December 2007, got a query in Jan 2008. Query was replied in February 08 first week and still the status is "Processing". My attorney stays now labor is taking several months and there is no such thing like 6 to 7 months. If labor itself takes more than a year then how bad it's going to be for other stages

              Filed in Nov 07

My case is very similar to smthambi. Filed for PERM in Nov '07, received Audit in Jan '08 and responded immediately (within a week or so) but haven't heard from DOL after that. Mine's EB2 category.

Last I heard from the attorney's office is that they have received an approval on 01/23/09 for a case that was filed on 08/07/07 where an Audit was issued.

And mentioned that it was good news since they had not received any approvals for a couple of weeks.

              Good Luck everyone!

DOL Issued Statistics Regarding the PERM Labor Certification Processing (2/17/2009)

Looking at following news, it seems that perm labor should not take more 6-7 months for approval (unless stuck in some audit process).
                  -----------------
The U.S. Department of Labor (DOL) recently issued statistics regarding the PERM labor certification processing. These statistics provide further insight into the backlogs and approval rates by the DOL on PERM cases. The summary is that there are over 50,000 PERM cases pending for processing and a substantial number of PERM cases are being audited by the DOL. Only about one in three cases is being approved or certified by the DOL.

This stage of the permanent residency, or "green card," process is critical and an appreciation of its complexities and nuances will help both employers and employees to be better prepared.

The statistics reflect that the number of cases received in the last quarter of 2008, October-December, far outweighed the number of cases resolved. The applications received totaled just over 20,700, and the completed cases for the same time frame totaled 4,571. The DOL reports that about 53,200 pending PERM cases were with them as of the end of December 2008. Of these, 26 percent are undergoing audits.

The DOL's released statistics reveal the number of filings received as well as the results of those filings, that were broken down as certified, denied, or withdrawn. The cumulative approval rate since the program began in March 2005 is 76 percent. The approval rate for the last quarter of calendar year 2008, however, was 67 percent. It is not clear if the change is a result of the economy or of additional auditing.

There is a lot of frustration among those who are waiting out the labor certification process. Knowing that one is not alone does not improve the situation, but the statistics make it clear that a delay does not indicate that a case is being singled out or overlooked. The statistics also make it clear that labor certifications are in no way a rubber-stamp process.

Note: Everyone reading this thread please update with your labor certification status. Like applied date, which catagory like EB2 or EB3 and center of application and ofcourse the status like pending/approved/query/denied etc.

Since we don't have any official date annoucement for labor certication, only if we share each other, we can come to know some kind of status on labor processing time.

                        Hi Kumar,

My company attorney filed my PERM process on Jan 2009 and today they said it will take 6 months. They are processing in Atlanta, but i am working in California. Somebody says it's automated process, which will take 45 days. Is there any issues with GC process now, because of the economy and new policy to scrutinize h1 guys in US.
