    Hi ,

    I just want to know - Is there any Validity/End Date for Labor Application i.e. If it is not APPROVED within some fixed time - You have to apply again.

    OR it remains valid untill USCIS takes some descision on it.

    Mine was filed in JUL-08 and still not approved.

    Which labor are you talking about? One for H1b or GC?

    LCA for H1b has validity depending on what the company requested it to be for until. The lawyer should know. Some ask for 2 years and some for 3 years, i.e duration of H1b.

        I140 has to be filed within 6 months of labor approval. That is the only condition.

          Hi txh1b,

          thanks for the info.
          One more question is :
          My H1 Petition is expiring in Feb'2010 and also I am completing 6 years then.

          Can I extend my H1 by an year on the basis of pending Labor Application/perm for green card (which was applied in SEP'2008 and still not approved)
          or it has to be APPROVED before I can extend my H1 again?

            Labor filed 365 days prior to expiration is good enough for extensions.
