H1 expiring

My H1 is expiring on Jan 2011. I transferred my H1 and got approved to a new employer on January 2009 and they are applying my labor in May. My concern is if My labor got cleared and my I140 didn't get cleared before Jan 2011. will it be a issue in extending it, or whether will it be extended only for 1 year. one more question If my 140 did not get approved, do I need to back to home to get my H1B stamped. Please let me know
