Currently I am in L1B, I came under intra company transfer. After 1.5 years my company plan to apply green card for me. Before coming here I was working in the same company in india for 4 years with prior experience of 2.5 years, when i contacted my lawyer they are telling that Experience before joining the current company only be counted. That means they can produce only 2.5 years of experience even though i have 8+ years of experience. Can you help me know whether is it a valid reason?

    Thanks,
    Ram

Read about progressive experience. The current job experience is useless unless the future job is at least 51% different than the current job.

The logic behind the requirement is if a USC without experience was hired for the same job as you do X years ago, they would be able to fill in that GC position. GC is for a future job in the company and to qualify for that, one should already have the experience and qualification, not obtain it through on the job training.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
