    I have applied for labor last year but it went to Audit. By next year iam going to complete my 6 years period. so can I extend my stay in US even though my labor is in audit condition. If yes what is the procedure?
    if not what I have to do ?

    Yes. If your labor is under audit, means there is no decision yet that it got approved or rejected. In that situation, you can apply for the extension of the stay. You can get 1 yr extension. And if you are lucky and labor got approved and before 6yrs if your I-140 also gets approved then you can get another 3yrs extension. But here to be specific, your labor should be filed at least before 365 days of your 6yrs stay in US.

      Labor audit

      Hi
      Last year I have applied for labor and it went to audit. If my labor which is in audit now gets rejected can I extend my stay in US after 6 years.If not what is the alternative procedure.

        My situation--Urgent help needed

        Hi Friends:

        I have 2 years of H1B period remaining. my current employer says he is not going to file my Labor for another 10 months or so. I think i am in danger!!!

        In this situation i have an alternative like my previous employer is ready to file for me,,,,is it better to go and join the previous company and start the GC process or stay with the current company and request my previous employer to process my GC based on future requirement.

        There are following reasons to worry about:
        1. My previous employer pays only 1/2 of what i am getting now (I feel that dosent matter as it is important to stay here in US)
        2. Job profile with current company and previous company are different, so if my previous employer files based on their job profile will it create any issue in geeting the labor approved.


        Another big question is when can i add my wife who is also on H1 to my GC application process??? Is it possible to add her after my labor approval.Because she has only 1 1/2 yrs left on H1B and she is already short of time...what can i do for her at this point of time....
