Six years of my H1B expires on Nov 2010. Company A filed for my PERM in March 2008, which is still pending. I have already received 1 year extension, when I started working for Company B, based on previous PERM and recapturing of the time outside US, which sets my H1B expiration to Feb 2012. I am planning to join Company C.
Company C is ready to file for the PERM immediately, but recruitment will take 2 to 3 months and my priority date could be June or July 2010.
1) Is it possible for Company C to file for PERM in July 2010 (which is really the 6th year considering the original H1B expiration date as Nov 2010) and be able to get approved before the new expiration date (expiration date after 1 year extension and recapture time)? Am I eligible for 1-year extensions based on new PERM filed by Company C (Please note that my original expiration date was Nov 2010, but I received 1-year extension based on PERM filed by Company A, which set the expiration date to Feb 2012).
I believe this problem, not to be that rare. There might similar situations like these. Please let me know if there is a solution.
