I currently hold a Engineering Manager position and I am getting ready to file PERM.The requirement for the position is BS and 5yrs of experience or MS and 3 years of experience.
My work/education timeline is as follows:
BS degree in EE
4 years of experience as a SW engineer
MS degree in EE (with 3 months as an Intern and 2 years as TA/RA)
9 months of experience with the current employer as a SW engineer at which point I was promoted to an Engineering manager. This was about 9 months ago.
I am about 2 weeks short of having exactly 5 years of experience prior to becoming a manager.
Do I qualify for EB2?
The questionable items:
I have no prior engineering manager experience,
MS degree is an alternate requirement, i.e. BS+5 is the first requirement.
I am being told that since MS+3 is an alternate requirement, this cannot be filed as EB2 (due to kellog language).
Does anyone have any knowledge in this area? Any thoughts/advice?
