EB3 Dates Retrogress

My labor was filed in Sep 04 in EB3 even though I have Masters and > 9 yrs. of experience. How does the EB3 dates retrogression affect me? Is there any way to change to EB2? Could there be any reason that it was not filed in EB2?

I think the EB2/EB3 categorization applies to I-140 onwards. You should be able to apply in EB2. I am not a lawyer. This is just a layman's suggestion. Pl. contact a lawyer for accurate advice.

EB2 & Retrogression

Does any of you know if retrogression is coming for EB2 as well.

My LC was filed under EB3 in March 2003 and should be getting approved soon.

But I'm thinking of asking my company to re-file it under EB2 (under PERM). Do you think it would be a good idea ? It would be a problem, if retrogression somes for EB2 as well.
Appreciate all advice.
