    Hello,

    I am currently have 1 year and 7 months left on my H1B before I complete my full 6 years.

    I have got a new job and the employer says that they will apply for my Labor process only after 3 months of evaluation.

    Now that being the case I will have only 4 months remaining for my Labor application to reach USCIS.

    I was also told that, I can reclaim the days I was not in the united states.

    I have been out of united states for nearly 3 months and 10 days since I was on my H1B.

    So that will give me a total of 7 months to begin my labor application..

    Is this enough time ? and is it true that I can reclaim the 3 months I was not in the united states ?

    Hoping for some help.

    Yes you can capture the time you were out of US.

    Regarding the time taken to file the labor from the point it is initiated -

    - It takes around 2 months to get prevailing wages.
    - Then 30 day period when job recruitment ads will be posted
    - Then 30 day cool off period, when job applications will be accepted.

    So its easily 4 months.

      How Long it takes from the date of Labor submitted

      Hi,

      In June My employer submitted the Perm Labor in EB2, so from the date of submission does anyone know how long it takes?
