Dear All,
My Labor was filed on June 1st 2009 and today I received an email from my attorney that the case has been picked up for audit. According to the attorney, The US Department of Labor has requested that my employer verify that it has complied the with the recruitment requirements of the PERM labor certification process.
a) Is this a routine audit and I should not be worried? (at present I am)
b) The attorney needs to respond by June 14th; does anyone know how long it will take after that?
c) The reaon I am further worried is because I am filing my H1 extension for the 7th year this month. With my labor process in Audit, I don't know what the chances are of my H1 extension getting through?
d) If my H1 extension gets through and I get a year's extension and after 3 months my labor gets denied, what are my options at this point? Do I have to return back to India immediately or can I appeal and stay based on my H1?
I really am confused as I did not expect to go through all these. Any help/response will be greatly appreciated?
