Our company has an employee currently on F-1 OPT who we wish to sponsor for an H-1B visa. On the LCA form, we specified the employment dates as 1/1/2005 - 1/1/2008 in hopes of making it under the 2005 H-1B cap, but we didn't make it. Now we are preparing the I-129 petition for an employment start date of 10/1/2005. Do I have to resubmit an entirely new LCA so that the start dates coincide, or can the H1-B start date be anywhere within the LCA employment dates?
