Situation:
1. I am working as a contractor for the client.
2. My employer(H1B holder) filed Labor Certification 3 months back. It was approved last week and They are now ready to file I140. Category is EB2.
3. My client now wantes to hire me full-time. They will also start my GC once hired.
What my options are/can be:
1.File I140 in premium category very soon so that i will get decision within 2-3 weeks(before joining the client full time.) and then use (port) this priority date for future GC filing.
2. Not to file I140. right now priority date in June 2010. If I start GC after joining client, priority date will be somewhat Nov, 2010. So why to waste 1000$(+500(i have to pay)) just for 4-5 months of priority date difference.
Questions:
1. If I file I140 in premium processing right now. Will I again have to file Labor and I140 when I apply GC thru my client(future employer)?
2. What is the best decision I should take in this scenerio? I am very confused. Experienced members, please guide.
