  • 6th Year of H1B and PERM in Process

    Hi,

My 6th year of H1B is expiting this December 18th. My employer applied for my labor on June 30th and it is still showing in process. Now the current processing date is July 2010. I was out of the country for 89 days. When I applied for the H1B transfer recently, the transfer came only for upto Dec 18th. How do I request the additional 89 days for which I was out of the country? What other options do I have to be in this country legally. I am on project currently and it is long term.

    Regards
    Madhu

The lawfirsm should have documented your out of country visits and requested that period be recaptured while filing for the extension. Now that it was not done, they would have to file for another extension to capture those 89 days meaning more $$$ for USCIS and the lawfirm.

Read the other thread about other options posted recently by another user.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
