  • PERM question

Please correct me if the following is wrong.

    1. I can get the PERM from company A and then the date applied for PERM is my Priority Date.

    2. If I change the employer A and go to employer B I have to re apply for PERM but the Priority Date will remain the same as with A.

    3. After PERM I can apply for I140 and while I 140 is underway I can change the employer to B.

    4. My I140 is approved and if Priodity Date is not current but still I can change the employer and apply I485 when PD is current.

Everything you have noted in your post is WRONG!

    1. Only if the I140 is approved is when you can carry the PD to a new employer. The I140 should not get cancelled either.
    2. See 1
    3. Then your employer B will have to start with a new PERM and new PD.
    4. Your new employer has to start over from scratch and process your Labor and I140 using the PD from previous I140. Then only you can file 485.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
