  • Does Company size a factor in LABOUR, OR I-140 OR 485

    Hi,

I have been searching to find an answer/your experience to know if Company size matters at all to any of the above three. I work in a Company which has 4 employees and with the revenue of around 500000 per annum. Does any one know or happen to find from your attorney wheter it matters.

My company's attorney says it is a factor but my companys financial status is ok and there wont be any problem.

does anyone or any of your friends you know of got through all the three from a small company like me...

It would be very helpful/encouraging to me to go with the flow or to take a different course.

    Regards.

I think it is too small for a company like this size to sponsor alien to get GC. For a company to sponsor alien to get his/her GC, I think it should be at least 15 to 20 people or above!

Yes, there was a rule for that, I did not know where was written, I did see this rule before! You could do you search through Internet!

If you think your company is not stable right now. From my own experience, please move to more establish and more stable company! (Since at present economic condition, this company can survive longer) Then, you can start your GC processing! Since company size like 4 people, the owner can close his/her company at any time or company can bankruptcy any time for any reason! Finally, you will find you waste your (H-1B duration time) time with this small company and then you need start your GC again at LC at state level with new company.

Since for each alien his/her H-1B is 6 years and I don’t know how much you remain? Stable income for your company now, it does not mean for next 4 to 5 years (GC processing time in CA). If you nationality origin are from following country: China (People Rep.), India, Philippine will be much longer! (Limited quota number impose by US Department of State)

Please make wise decision before start!

(Note: This is not a legal advise, use it a your own risk)

As long as the company has money to pay you prevailing wages, company size does not matter much.

But as other person pointed out, what happens if they don't have enough money in near future and can't afford to pay you? If you think that is going to be OK, then I don't see any problem.
