I went to two different immigration lawyers and received two completely different views on the labor certification job description and job advertisement. One laywer said that the company should advertise for the position they intend to hire for, regardless if some of the qualifications may exclude US citizens, by including the higher end qualifications necessary to perform the job. The other lawyer said to advertise for a "dumb down" position to show the DOL that a great effort was made to recruit US citizens by making it as inclusive as possible by not requiring any higher end qualifications required to perform the job, but only a few basic qualifications. What have you heard and/or experienced regarding this?
