  • green card process

    Hello,

I am in my 5th year of my H1b and I want to start my Green Card process. My employer has been saying for the last couple of months that they are going to start it but I am not sure whether they did actually start. I sent them an email couple days ago and below in quoted text is the email I received but I am not sure whether to believe them. Please help

NOTE: I was not asked to submit any documents and my signature was not asked for anything.

"We are still waiting on the DOL to review your job description, which takes up to 6 weeks. Attorneys sent the paperwork to the DOL on July 26. Once finalized, we will move to the next step which is recruitment (showing you are the best candidate for the position). I am currently gathering information for Trupti which will hopefully speed up this step, and we will not have to go through it.

I will let you know once we hear back from the DOL."

    Thanks,
    Raghav

It is true that DOL takes around 6 weeks to approve the job decription and then you can go ahead apply for labor. But find out from the employer what is the job requirement and under which it falls. Whether it will be filed under eb2 or eb3?

Pl note i'm not an attorney and it is a suggestion. Pl contact your attorney for further details.
