Promotion and EB2

I have 3 yrs BSc degree in Physics, Maths and Electronics and have I140 approved in EB3. I have 14 yr of exp and 9 yrs in US. My employer is offering me promotion where I will become development manager and will have 6 direct reports. I am working with same employer from last 5 yrs. I would like to know can I file new labor once I get promotion in EB2 category. Please note I have 3 yrs degree and then 6 months post graduation diploma from India.

You could possibly do that and port the new petition with old date provided the new position requires experience that qualifies one for the job in EB2. It is not what you have but what the job needs that is important. The most important hurdle I see for you is your 3 year degree and I40 approval can be the biggest challenge.

Thanks for your reply!! Job requirements will be of managerial position so EB2 can be justified. But can I really file for EB2 with 3 yr degree?
